Innosuisse - Legal framework for reuse
Whoever wants to build needs a binding, regulatory contractual situation. When building with components to be reused, this remains unchanged. However, new issues may arise when re-using building components, which are explained and taken into account in the following documents.
These documents were drawn up as part of the "Reuse of building components: legal framework" project co-funded by Innosuisse (project no. 55734.1 IP- SBM) in collaboration with Zirkular GmbH / baubüro in situ and the Zürcher Hochschule für Angewandte Wissenschaften ZHAW, School of Management and Law, Fachstelle Städtebau- und Umweltrecht.

03.01 Specialized planning contract for circular construction (ziB)
The ziB specialized planning contract regulates the definition of the project, the scope of services, the various elements of the contract, as well as remuneration, deadlines, insurance and liability between the principal and the contractor.
03.02 General conditions of contract (AVB) for the specialized planning contract for circular construction (ziB)
The GTC for the specialized planning contract for circular construction (CCC) specifies the general points, tasks and services relating to the source and target objects.
04 Declaration of intent
The declaration of intent regulates the rights, obligations and remuneration for the planned takeover of building components between the assignor and the interested party.
05 Transfer agreement
The transfer agreement regulates the organization, remuneration, guarantee and liability for the transfer of building components between the transferor and the transferee.
06 Contractual clauses Dismantling
These contractual clauses govern the dismantling of reusable components during dismantling by a dismantling company or a dismantling contractor.
07 Contractual clauses Repositioning
These contractual clauses focus on the reinstallation of building components in the target object. The positions are designed to be integrated into corresponding work contracts with construction companies.
08 Factsheet Liability
This information sheet deals with certain liability issues when reusing components in the context of dismantling components and reinstalling (assembling) them in the target object, as well as some special questions.
09 Factsheet Authorization
The information sheet refers to the authorizations that may need to be obtained for the source and target objects, as well as for the storage, collection, transport and transfer of components to be reused, and classifies them in legal terms.
10 Information sheet on legislation governing construction products
The information sheet shows for whom the legislation on construction products lays down which obligations, and classifies reusable construction elements within its scope.
